TERMS
OF USE.

These Terms govern use of EZ Rally apps and services. EZ Rally is an assistance tool; official event rules, organizer data, roadbooks, traffic laws and official timing always take precedence.

1. Acceptance

By downloading, accessing or using an EZ Rally app, you agree to these Terms and to any applicable App Store terms. If you do not agree, do not use the app.

2. License and Permitted Use

EZ Rally grants you a limited, personal, non-exclusive, non-transferable license to use the app on compatible devices in accordance with these Terms and applicable platform rules. You may not copy, resell, reverse engineer or misuse the app except where applicable law expressly permits it.

3. Purpose of the Apps

EZ Rally Tripmeter assists with rally distance and speed. EZ Rally Timer assists with regularity-rally timing and control progression. They are not official timing instruments, navigation authorities, safety systems or substitutes for organizer instructions.

4. Free Use and Purchases

Tripmeter includes an initial distance allowance, currently the first 100 km, with product features available for evaluation before unlock. Timer Free is designed for 1 Event, 1 Day and up to 5 PCs. Timer Full is designed for up to 10 saved Events, up to 10 Days per Event and up to 999 PCs per Day.

Prices and availability are those displayed in the App Store at the time of purchase. Paid functionality is provided as an in-app purchase unless otherwise stated in the store listing.

5. Billing, Restore and Refunds

Apple processes App Store billing. Restore functionality is subject to the Apple account and platform rules. Refund requests are handled under Apple's applicable policies. EZ Rally does not directly control App Store refund decisions.

6. Accuracy and Limitations

GPS reception, device sensors, device hardware, operating-system behavior, background execution, tunnels, buildings, weather or environmental conditions, calibration, user input, roadbook data and event setup can affect results. Timing and distance values may contain errors or become temporarily unavailable.

You are responsible for checking rally data and settings before use. No particular accuracy, rally result, classification, penalty outcome or uninterrupted availability is guaranteed.

7. Official Event Information Takes Precedence

If EZ Rally differs from an organizer's roadbook, official timing, marshal instruction, event regulation or other official information, the official event information takes precedence. Use EZ Rally only as an assistance tool within the rules of the event.

8. Safety Comes First

Drivers must not interact with EZ Rally while driving. Configure the app before starting. If an interaction is required while the vehicle is moving, it must be performed by a co-driver or passenger where permitted by local law and event regulations. If safe operation requires stopping, stop in a safe and lawful place before interacting with the device.

Never allow the app, a screen, an alert or a competition objective to distract from safe control of the vehicle or compliance with traffic law.

9. Timer Trigger Responsibility

Timer is designed so SPC, PC and CO progression depends on the co-driver's actual tap rather than an automatic assumption that a line has been crossed. The user remains responsible for determining the correct control, actual passage and appropriate time to trigger the app.

10. User Data and Event Setup

You are responsible for the accuracy of Events, Days, SPC / PC / CO entries, distances, speeds, times and other information entered into the apps. Review duplicated or reused Event data before competition.

11. Availability and Changes

Features may be improved, modified or discontinued as devices, operating systems, rally requirements and the EZ Rally product line evolve. Compatibility with every device, operating-system version or event format is not guaranteed.

12. Intellectual Property

EZ Rally, its software, interface, graphics, branding and related materials are protected by applicable intellectual-property laws. Third-party trademarks remain the property of their respective owners.

13. Disclaimer

To the maximum extent permitted by applicable law, EZ Rally is provided on an “as is” and “as available” basis without warranties that the app will be error-free, uninterrupted or suitable for every rally, road, jurisdiction or competition format.

14. Limitation of Liability

To the maximum extent permitted by applicable law, EZ Rally and its provider will not be liable for indirect, incidental, special or consequential losses arising from use of the app, including lost rally results, penalties, disqualification, lost data or inability to use the app. Nothing in these Terms excludes liability that cannot legally be excluded.

15. Applicable Law and Event Rules

You are responsible for complying with the traffic, mobile-device and competition rules applicable where you use EZ Rally. These Terms do not override mandatory rights or protections that apply under local law.

16. Changes to These Terms

These Terms may be updated as the products or applicable requirements change. The date at the top identifies the latest published version.
